Terms of Use

1. Provider

Roxzone is operated by:

Roxzone Performance UG (haftungsbeschränkt)
Managing Director: Jonathan Faber

(hereinafter referred to as "Roxzone")

2. Scope

These Terms of Use apply to the use of the Roxzone online platform.

By registering for and using the platform, the user accepts these Terms.

3. Description of services

Roxzone is an independent community platform for HYROX athletes.

The current scope of services includes in particular:

• matching of race partners,
• publication and search of ticket listings,
• communication between users within the platform.

Roxzone is not itself an organiser of competitions and not a seller of tickets.

Roxzone reserves the right to adapt, expand or discontinue individual functions of the platform at any time.

4. Independence from HYROX

Roxzone is an independent platform and has no commercial, organisational or legal connection to HYROX.

Roxzone is neither operated nor supported nor officially represented by HYROX.

All trademark, name and identifier rights remain with their respective owners.

5. Registration and user account

Registration and use of Roxzone is permitted exclusively to persons of legal age (18 years and older).

The user undertakes to:

• provide truthful information,
• treat access credentials confidentially,
• not create an account on behalf of third parties,
• not use the platform abusively.

As a rule, each user may maintain only one user account.

The user is responsible for all activity that occurs via their user account.

6. User profiles

Roxzone may display certain profile data publicly. This may include in particular the first name and the initial letter of the last name.

The user is responsible for the content of their profile.

In particular, the following are prohibited:

• false identities,
• insulting content,
• discriminatory content,
• unlawful content,
• misleading information,
• spam or unsolicited advertising.

7. Race partner matching

Roxzone provides only the technical platform.

Agreements, arrangements and other contacts between users are made exclusively on the participating users' own responsibility.

In particular, Roxzone makes no warranty regarding:

• the accuracy of user information,
• the reliability of other users,
• actual participation in competitions,
• the athletic capability of a user,
• the conclusion of a partnership.

8. Ticket listings

Roxzone does not itself offer tickets for sale.

Users can publish information about available tickets and contact other users.

All purchase, sale and transfer agreements are made exclusively between the participating users. Roxzone does not become a party to these agreements.

Roxzone does not verify the identity, entitlement or reliability of a ticket seller and gives no guarantee for the successful transfer of a ticket.

The user is responsible for ensuring that a ticket transfer is permitted under the rules and conditions of the respective event organiser.

Roxzone is not liable for failed transfers, invalid tickets, false statements or other disputes between users.

9. Prohibited use

In particular, it is prohibited to:

• violate applicable law,
• infringe the rights of others,
• publish unlawful content,
• harass, threaten or deceive other users,
• use automated access, bots or scraping technologies,
• distribute malware or harmful content,
• impair the functionality of the platform.

10. Account suspensions and content moderation

Roxzone is entitled to review, restrict, hide or remove content, user profiles and user accounts at its discretion when there are indications of violations of these Terms, applicable law or the interests of the platform.

Roxzone may suspend user accounts temporarily or permanently if:

• these Terms are violated,
• unlawful content is published,
• the platform is misused,
• the security or functionality of the platform is impaired.

There is no claim to permanent use of the platform.

11. Liability

Roxzone provides only the technical platform.

Roxzone is not liable for agreements, transactions, contacts or other interactions between users.

In particular, Roxzone accepts no liability for:

• the authenticity or availability of ticket listings,
• the accuracy of user information,
• the conduct of other users,
• the formation of race partnerships,
• failed ticket transfers,
• disputes between users.

Statutory liability for intent, gross negligence and for damages resulting from injury to life, body or health remains unaffected.

12. Availability of the platform

Roxzone endeavours to keep the platform available with as few disruptions as possible.

Continuous and uninterrupted availability at all times cannot, however, be guaranteed.

Maintenance work, technical disruptions, security measures or events of force majeure may in particular lead to temporary restrictions.

13. Changes to the platform

Roxzone is entitled to modify, expand, restrict or discontinue platform functions, provided that no mandatory statutory rights of users are violated.

14. Changes to these Terms

Roxzone reserves the right to adapt or amend these Terms for objective reasons.

Registered users will be informed of material changes in an appropriate manner.

15. Final provisions

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these Terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.
